Detective arrested woman by “mistake” then rapes her

A Cape Town detective has been arrested after he allegedly raped a woman inside jail cells on Christmas Day at Malmesbury cop shop. It is alleged that on 25 December, the officer went to the house of the victim and arrested her on allegations of theft.

The officer who is current detained at Riebeek SAPS took the 41-year-old woman to the cop shop but on arrival she told her that she had arrested her by mistake. The detective aged 41 started drinking booze and encouraged the woman to also drink but she refused. The woman decided to leave but it was when she was chocked and raped allegedly the officer.

Independent Police Investigations Directorate (IPID) spokeswoman Lizzy Shuping said the woman reported the matter to cops leading to the arrest of the officer.

“The complaint further alleges that at the police station the accused officer told her that she was picked up by mistake but encouraged her to drink alcohol with him. When she refused, he allegedly took off his clothes, lay on the cell mattress and pretended to be asleep.

“As she tried to leave, the accused officer grabbed her from behind, choked her, tore her clothes and raped her. After the ordeal, the officer allegedly dropped her off in town. A rape case has been opened and medical reports have also been obtained. The victim’s torn clothes were also handed over as evidence,” said Shuping.
The detective is expected to appear in court on Monday 30 December 2024.

The incident happens barely a month after a Mfuleni SAPS Constable Siyabonga Mbane allegedly raped a 26-year-old old in jail cell last month. It is alleged that the 26-year-old victim was locked in the cells with the other suspects five suspects on Friday 29 November 2024. Mbane allegedly went to the cell and called the woman to accompany him as if he were going to ask him some questions. Instead, he took him to an empty cell and raped her. It is alleged that he raped the woman two times on the same night. After the incident, the officer took the woman back to the cells.

Mbane was denied bail and spent his Christmas behind bars. His case was postponed to 20 February for further investigations.
